Great website of NYS law/codes for the future referance of all intrested :
http://www.safeny.com/equi-vt.htm
See "Stop Lamps"
40. (b) Every motor vehicle, except a motorcycle, operated or driven upon the public highways of the state, if manufactured on or after January first, nineteen hundred fifty-two, shall be equipped with at least two stop lamps, one on each side, each of which shall display a red to amber light visible at least five hundred feet from the rear of the vehicle when the brake of such vehicle is applied.
Although the top of the page does have a nice disclaimer warning you......
this is what its "paraphrased" from:
http://public.leginfo.state.ny.us/menugetf.cgi?COMMONQUERY=LAWS
VAT Title 3 Article 9:
§ 376. Lamps, signaling devices and reflectors on vehicles. 1. (a) It
shall be unlawful to operate, drive or park a vehicle, except a
motorcycle operated during the period from one-half hour before sunrise
to one-half hour after sunset, on any public highway or street in this
state at any time during the day or night unless such vehicle is
equipped with signaling devices and reflectors of a type approved by the
commissioner which are in good working condition; or to operate, drive
or park a vehicle, except a motorcycle, on any public highway or street
in this state, during the period from one-half hour after sunset to
one-half hour before sunrise, unless such vehicle is equipped with lamps
of a type approved by the commissioner which are lighted and in good
working condition.
(b) The commissioner of motor vehicles is hereby authorized and
empowered to promulgate rules and regulations with respect to lamps,
reflectors and signaling devices, their number, type, design,
construction, location, attachment and use on vehicles being driven,
operated or parked on any public highway or street in this state. In
promulgating such rules and regulations the commissioner shall be guided
by the requirements with regard to lights, reflectors, signaling devices
and associated equipment on vehicles of rules and regulations
promulgated by the United States department of transportation.
2. Wiring used on commercial vehicles shall be of such size that when
all connections are made in an acceptable and workmanlike manner the
loss in voltage will not be sufficient to cause a lamp to produce less
than the minimum candlepower, under normal operating conditions, when
the lamp is in good working order. All wiring should be enclosed in
weather proof and abrasion proof cable or conduit except wiring which is
completely enclosed within the body of the vehicle.
3. All lights, signals and reflectors shall be of a type and design
approved by the commissioner. No light having a candlepower rating in
excess of thirty-two candle power shall be used on any vehicle, unless
it is of a type approved by the commissioner. The provisions of section
three hundred seventy-five of this chapter governing the approval of
equipment and the adjustment of headlamps shall apply to the equipment
and headlamps required by this section. The commissioner is hereby
authorized and empowered to adopt and from time to time amend such
regulations not inconsistent with this section, governing the size,
type, construction, location, and use of lights, signals and reflectors,
including the exemption of specific vehicles from the requirements of
this section where the construction of such vehicles makes compliance
herewith impracticable, or impossible.
4. All existing provisions of this chapter governing the use of
headlamps, front parking lamps and license plate lamps and other lamps,
reflectors, lights and directional signals on vehicles shall continue to
apply, except to the extent irreconcilably inconsistent with the
provisions of this section or regulations promulgated thereunder.
As far as mufflers go its a crap shoot, if you car can be "plainly audible" from a half football field, your actually in violation..to me it's worded and enforced 100% as a money maker law. So pretty much OEM mufflers are the only sure bet to dodge the fuzz.
§ 24-236 Motor vehicles. (a) Motor vehicles, other than motorcycles,
with a maximum gross weight of 10,000 lbs. or less. No person shall
cause or permit any motor vehicle, other than a motorcycle, with a
maximum gross weight of 10,000 lbs. or less to operate on a public
right-of-way where the muffler or exhaust generates a sound that is
plainly audible to another individual at a distance of 150 feet or more
from the motor vehicle.
Learn the law and PUNCH IT threw any loopholes while you still can!!!!!! _________________ Best Formula N-A 12.1 @ 110 (pre-engine swap) |

Yeah, the actual laws and then the way a officer reads it, gets kind of mixed up. Someone on a forum with a stock vette (maybe a Z06) got a ticket from a anal cop for having a loud exhaust. He pleaded that his car was stock, and came that way. Got the ticket...judge didnt want to hear it either.
So, unless you have a lawyer to help you break through the loop holes...more than likely you wont win. I've had enough tickets in my day and have tried to argue the obvious truth to the judge (because arguing with the office is wasting your breath) about stupid things like when the law didnt mention that you couldnt have 25% blocking tint on the rear quarter windows and you could have as dark as you want on the rear window. I got a ticket in the small town of Corfu, argued my point, EVEN BROUGHT THE COPY OF THE LAW, and STILL gave me a ticket for $50. He said, "well, I nor one of the officers isnt going to go check it so, $50 for the surcharge or we could carry this out to trial and you can pay more." So, its up to you. I've said it all along...the law has you by the balls, its up to you to lay low or be a target. I choose to lay low. |

If you're addressing me...it don't matter to me. I'm just telling people like Ed that if its not stock or if it doesn't blend in with the rest of the cars on the road, and a cop is in the frisky prick mood, he will give you a ticket for something like that.
Believe me, cops and judges love when someone tells them the law as much as we love getting pulled over for stupid shit. You might go a day, you might go years...you might go without ever getting a ticket. I'm just sayin'.
Example: I've received 3 tickets just for tint since I was 17 to 23~ and now don't choose to tint my windows. My friend has tinted his windows almost black all around on every vehicle he has owned, and has NEVER been friggen pulled over. Just food for thought. |
